1. Agreement

These Terms of Use ("Terms") are an agreement between you and EdNinja ("we", "us") for the SoundMatch app ("the app") and this website. By downloading or using the app you accept these Terms and our Privacy Policy. If a child uses the app, the parent or guardian accepts these Terms on the child's behalf.

The app is licensed to you through Apple's App Store. Apple's Licensed Application End User License Agreement ("Apple EULA") also applies. If these Terms and the Apple EULA conflict, the terms that give you more protection apply.

2. Your license

We give you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as allowed by the App Store's Usage Rules, including Family Sharing. Teachers and therapists may use it with the children they work with.

You may not copy, modify, reverse engineer, redistribute, sell or rent the app, or extract its sounds, images, characters or other content, except where the law allows it regardless of these Terms.

3. SoundMatch Premium subscriptions

• SoundMatch Premium unlocks every sound world and Shuffle mode. It is offered as a monthly or a yearly auto-renewing subscription. Current prices are shown in the app before you buy, in your local currency.
• Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically at the same price and length unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription at any time in your Apple Account settings. Cancelling stops future renewals; you keep Premium until the end of the period you already paid for.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• If you reinstall the app or get a new device, tap "Restore Purchases" in the app to get Premium back.
• Purchases are behind a parent lock. Parents are responsible for purchases made on their devices.

4. Your content

Names and photos you add to the app stay on your device and belong to you. Please only add photos you have the right to use.

5. Our content

The app, the website, the SoundMatch and EdNinja names and logos, the characters, artwork, recordings and code are owned by EdNinja or our licensors and protected by intellectual property laws. These Terms don't give you any rights to them other than the license above.

6. Changes and availability

We work to keep SoundMatch fun and up to date, so we may add, change or remove features or content. We may stop offering the app. If we discontinue Premium, we will tell you in advance where we can and you will not be charged for future periods.

7. Disclaimers

SoundMatch is an educational game, not a medical, diagnostic or therapeutic service. If you have concerns about your child's hearing, speech or development, please talk to a qualified professional.

To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the app will be uninterrupted or error-free.

8. Limitation of liability

To the extent the law allows, EdNinja will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us for the app in the twelve months before the claim. Some places don't allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

9. Apple

These Terms are between you and EdNinja, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws rules. If you live in the European Union or another place whose laws give you the right to bring claims in your local courts or under your local law, you keep that right.

11. Changes to these Terms

We may update these Terms. We will post the new version here and change the date at the top, and tell you in the app if a change is significant. If you keep using the app after a change, you accept the updated Terms.

1. Acuerdo

Estos Términos de uso ("Términos") son un acuerdo entre tú y EdNinja ("nosotros") sobre la app SoundMatch ("la app") y este sitio web. Al descargar o usar la app aceptas estos Términos y nuestra Política de privacidad. Si un niño usa la app, su madre, padre o tutor acepta estos Términos en su nombre.

La app se te concede bajo licencia a través de la App Store de Apple. También se aplica el Contrato de licencia de usuario final de aplicaciones con licencia de Apple ("EULA de Apple"). Si estos Términos y el EULA de Apple no coinciden, se aplica lo que te dé más protección.

2. Tu licencia

Te damos una licencia personal, no exclusiva e intransferible para usar la app en dispositivos Apple que tengas o controles, según las Reglas de uso de la App Store, incluida En Familia. Maestros y terapeutas pueden usarla con los niños con los que trabajan.

No puedes copiar, modificar, aplicar ingeniería inversa, redistribuir, vender ni alquilar la app, ni extraer sus sonidos, imágenes, personajes u otro contenido, salvo cuando la ley lo permita igualmente.

3. Suscripciones SoundMatch Premium

• SoundMatch Premium desbloquea todos los mundos de sonidos y el modo aleatorio. Se ofrece como suscripción mensual o anual de renovación automática. Los precios vigentes se muestran en la app antes de comprar, en tu moneda local.
• El pago se carga a tu cuenta de Apple al confirmar la compra.
• La suscripción se renueva automáticamente con el mismo precio y duración salvo que la canceles al menos 24 horas antes del final del periodo. La renovación se cobra dentro de las 24 horas previas al final del periodo.
• Puedes gestionar o cancelar la suscripción en cualquier momento en los ajustes de tu cuenta de Apple. Al cancelar se detienen las renovaciones; mantienes Premium hasta el final del periodo ya pagado.
• Los reembolsos los gestiona Apple según sus políticas. Puedes pedir uno en reportaproblem.apple.com.
• Si reinstalas la app o cambias de dispositivo, toca "Restaurar compras" en la app para recuperar Premium.
• Las compras están tras un candado para padres. Los padres son responsables de las compras hechas en sus dispositivos.

4. Tu contenido

Los nombres y fotos que añades a la app se quedan en tu dispositivo y son tuyos. Añade solo fotos que tengas derecho a usar.

5. Nuestro contenido

La app, el sitio web, los nombres y logotipos de SoundMatch y EdNinja, los personajes, ilustraciones, grabaciones y código pertenecen a EdNinja o a sus licenciantes y están protegidos por las leyes de propiedad intelectual. Estos Términos no te dan más derechos sobre ellos que la licencia descrita.

6. Cambios y disponibilidad

Trabajamos para que SoundMatch siga siendo divertida y esté al día, por lo que podemos añadir, cambiar o quitar funciones o contenido. Podemos dejar de ofrecer la app. Si dejamos de ofrecer Premium, te avisaremos con antelación cuando sea posible y no se te cobrarán periodos futuros.

7. Avisos

SoundMatch es un juego educativo, no un servicio médico, de diagnóstico ni terapéutico. Si te preocupa la audición, el habla o el desarrollo de tu hijo, consulta a un profesional cualificado.

En la medida en que la ley lo permita, la app se ofrece "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, incluidas las de comerciabilidad, idoneidad para un fin concreto y no infracción. No garantizamos que la app funcione sin interrupciones ni errores.

8. Limitación de responsabilidad

En la medida en que la ley lo permita, EdNinja no será responsable de daños indirectos, incidentales, especiales, consecuentes o punitivos, ni de la pérdida de datos, derivados del uso de la app. Nuestra responsabilidad total por cualquier reclamación sobre la app se limita a lo que nos pagaste por ella en los doce meses anteriores. Algunos lugares no permiten estos límites, así que puede que no se apliquen a ti. Nada en estos Términos limita los derechos irrenunciables que te dan las leyes de protección al consumidor.

9. Apple

Estos Términos son entre tú y EdNinja, no Apple. Apple no es responsable de la app ni de su contenido, no tiene obligación de dar mantenimiento ni soporte, y no responde de reclamaciones relacionadas con la app. Si la app no cumple una garantía aplicable, puedes avisar a Apple y Apple podrá reembolsar el precio de compra; Apple no tiene ninguna otra obligación de garantía. Apple y sus filiales son terceros beneficiarios de estos Términos y pueden hacerlos valer frente a ti.

10. Ley aplicable

Estos Términos se rigen por las leyes del Estado de California, EE. UU., sin tener en cuenta sus normas sobre conflicto de leyes. Si vives en la Unión Europea u otro lugar cuyas leyes te permitan reclamar ante tus tribunales locales o según tu ley local, conservas ese derecho.

11. Cambios en estos Términos

Podemos actualizar estos Términos. Publicaremos la nueva versión aquí, cambiaremos la fecha de arriba y te avisaremos en la app si el cambio es importante. Si sigues usando la app después de un cambio, aceptas los Términos actualizados.
